One of the big lies from the corporate community and the corporate legal community is that all sorts of court time is being taken up by people suing for frivolous matters. This is pure baloney. The overwhelming number of civil cases choking the courts are brought by big money corporations against other big money corporations. These suits often take years to settle. Synopsis: A class action lawsuit against AvTel Communications, Inc. (Nasdaq: AVCO) and certain officers and directors was filed in the Central District of California on behalf of those whose purchased AvTel common stock on November 12, 1998. AVCO says it is a provider of broadband network services that integrates voice, data and video networking services, and that it also markets and sells a broad range of telecommunications and advanced network services in the Santa Barbara area. The complaint against AVCO is based upon an announcement it made on or about November 12, 1998, that its DSLink Service would provide "high-speed Internet access over Asymmetric Digital Subscriber Line (ADSL)" and represented that "ADSL is a new modem-based technology that provides a dedicated connection to the Internet that is up to 50 times faster than conventional modems." Defendants also stated that AVCO intended to roll out the DSLink Service on a nation-wide basis. As a result of these statements, the Company's stock skyrocketed from $2.375 per share to over $36 per share, representing a one-day gain of over 1400 percent before NASDAQ halted trading on the stock. One day later, AVCO admitted that, contrary to its representations just one day earlier, it had no proprietary technology or products at all and no existing plans for national expansion. As a result of these admissions, the Company's stock opened about $33 down at $3.00 per share on Monday November 16, 1998. Investors who trusted the company's announement now want to recover damages. They are represented as class members by the law firm of Weiss & Yourman.
