No country will long exist if its older leaders persist in sending young people
off to die
in war. But, it's equally clear that a nation's unwillingness to fight
encourages the
leaders of some countries to start wars. In a country that was not run by
politicians
for the sake of special interest groups, the individual citizen would look at
history and decide
if devastating wars are more or less likely to occur when the nation was ready
to fight, or
eager to negotiate. Unfortunately, in the USA, American citizens no longer
get the choice.
Republican and Democrat politicians, who are not likely to lose their lives in a
war, decide
whether or not going to war is best for themselves and the special interest
groups who
pay them.
With regards to a possible war with Iraq in 2002, there will not be any.
Article I, Section 8 of
the Constitution makes it clear that it is the legislative branch of government
that has the
power "To declare war." Since Congress has not declared war, there cannot
be one. This
does not mean that Americans will not fight and die in a war with Iraq.
Politicians have long
been able to have the trappings and benefits of war for themselves, without
asking
Congressional politicians to publicly vote on such matters.

Truman went to war against North Korea in 1950 without asking Congress for
authority. Since that time. presidents regularly have used military force by
relying on what they regard as independent and self-sufficient sources of
authority, especially the commander-in-chief clause. These assertions of
political power have no legal foundation. . . .
"The framers knew all about monarchical systems that allowed one person to
send the nation into war. . . . Instead of leaving the war power in the hands
of an executive, the framers relied on collective decision-making through
legislative deliberation. . . . The president could take actions necessary to
resist sudden attacks. . . . But the president never received, as Mr. Clinton
apparently believes, a general power to deploy troops whenever and wherever he

With regards to using military power it is clear the President has the
power to
respond to immediate threats. It is also clear that America's two party
politicians have toyed
inappropriately with the Constitution. Either the Constitution must be
amended to allow for the
acts of past Presidents like Truman and Clinton, or Presidents must stop the
unilateral sending
of troops to foreign lands. Unfortunately, as long as the two parties are
in power, nothing
will happen. When the President makes the choice to send troops somewhere,
100s of
Republican and Democrat politicians manage to avoid voting on the matter.
Hundreds of
Republican and Democrat federal politicians get to play Pontius Pilate.
The only way
to prevent lots of unilaterally declared pseudo-wars, masquerading as police or
UN actions,
is to get get rid of the Republicans and Democrats. Alternatively, we
could influence one
of the parties to restore a Constitutional procedure for declaring war, or write
an amendment to
the Constitution.
When Congress must vote to send Americans off to fight and die, the desires of
citizens are most
likely to be voted. If a Constitutional amendment occurs to legitimize the
president sending
troops off to fight, citizens will have to approve it. It is sometimes
amazing how the people
become involved in major decisions when the Constitution's words are used rather
than the current
desires of politicians supporting special interest groups.
